Germany Moves to Protect Top Court Against Far-Right Interference
In a move aimed at safeguarding its democratic institutions and upholding the principles of judicial independence, Germany’s ruling coalition has passed a law designed to prevent potential interference by far-right extremists within the country’s highest court, the Constitutional Court (Bundesverfassungsgericht or BVerfG).
The measure, known as the "Secrecy of the Constitutional Court’s Deliberations" or "Vorab-Furteregesetz", prohibits individuals suspected of extremism from attending top-secret sessions or discussions involving the court’s judges or magistrates. This includes the potential removal of judges from sensitive caseloads or high-security matters involving national security and immigration policy.
According to officials, the legislation aims to address growing concerns over the spread of far-right ideology in the judiciary and government institutions, which were amplified following the 2021 presidential election. This worry has led to an inquiry by Germany’s intelligence services to monitor any suspicious activities or loyalties among judges, ensuring the impartiality of the nation’s top court.
Threats to the Court’s Integrity

"In these trying times, we cannot overlook the imperative of ensuring the integrity of our judges and protecting the BVerfG’s ability to function impartially. "Germany has every reason to bolster its democratic defenses after experiencing first-hand the pernicious impact of extreme-right ideology under Hitler and the Nazis," underscored Dr. Henrike Schultze-Cirkorny, a renowned sociologist, in a speech on the dangers of far-right terrorism and ideological contamination.
